These Terms & Conditions (“Terms”) govern your use of the website located at https://thegravelcompany.com (the “Website”) and any purchases made from The Gravel Company, LLC (“Company,” “we,” “our,” or “us”).
By accessing our Website, placing an order, or purchasing materials from our yard locations, you agree to these Terms.
1. Products & Natural Material Disclaimer
The Gravel Company sells natural stone, gravel, sand, soil, and related landscape and construction materials.
Because these are natural products:
- Color, size, texture, and composition may vary
- Materials may differ from website photos
- Stone may contain dust, fines, or minor debris
- Size classifications (e.g., 3/4″, 2–4″) are approximate
- No two loads are identical
All materials are sold “AS IS.”
2. Measurement & Quantity Disclaimer
- All scoop, bag, super sack, and bulk quantities are approximate
- Weight varies based on moisture content and material density
- Coverage estimates provided on the Website are general guidelines only
- Customers are responsible for calculating and verifying quantities prior to purchase
The Company is not responsible for shortages, overages, project delays, or additional costs resulting from customer miscalculations.
3. Pricing & Payment
- Prices are subject to change without notice
- Payment terms may vary depending on customer account status
- Applicable sales tax will be added where required by law
- The Company reserves the right to refuse or cancel any order at its discretion
4. Delivery Policy
Customers receiving delivery must:
- Provide accurate delivery instructions
- Ensure safe and adequate access for delivery trucks
- Confirm that driveways and property surfaces can support heavy truck weight
- Clearly mark underground utilities, irrigation lines, septic systems, and other concealed structures
Loaded delivery trucks may exceed 30,000 pounds.
The Gravel Company is not responsible for:
- Cracked or damaged driveways
- Surface damage due to truck weight
- Damage to landscaping, curbs, or hidden utilities
- Site conditions beyond the driver’s control
Drivers may refuse delivery if site conditions are deemed unsafe.
Delivery is considered complete once material has been unloaded at the customer-designated location.
5. Dump Location
The customer must clearly designate the dump location prior to unloading.
Once material is dumped:
- It cannot be moved
- It cannot be returned
- The order is considered final
6. Yard Operations & Safety
For safety and insurance reasons:
- Customers are not permitted to load themselves
- All materials are loaded by Company personnel
- Customers must remain in designated safe areas while equipment is operating
Failure to follow yard safety instructions may result in refusal of service.
7. Returns & Refunds
Due to the nature of bulk landscape and construction materials:
- All bulk material sales are final
- No returns or refunds are permitted once material has been loaded or delivered
- Delivery fees are non-refundable once dispatch has occurred
- Any approved refund will be issued to the original payment method
8. Limitation of Liability
To the fullest extent permitted by law, The Gravel Company shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits
- Installation errors
- Structural failure due to misuse
- Improper site preparation
- Project delays
Customer assumes full responsibility for proper installation and application of materials.
9. Attorney’s Fees
In the event of any dispute, claim, or legal action arising out of or relating to these Terms, the purchase of materials, or services provided by The Gravel Company, the prevailing party shall be entitled to recover its reasonable attorney’s fees, court costs, and related expenses.
10. Governing Law
These Terms and any disputes arising out of or relating to the use of this Website, the purchase of materials, or services provided by The Gravel Company shall be governed by and construed in accordance with the laws of the State of Tennessee.
Any disputes shall be resolved exclusively in the State of Tennessee, and The Gravel Company reserves the right to select the proper venue within Tennessee.
11. Website Use
Users agree not to misuse the Website, interfere with its operation, or attempt unauthorized access.
The Company reserves the right to suspend or terminate access for violations of these Terms.
